Norman McKinny appeals from a jury verdict in favor of the defendants in this ? 1983 action for false arrest, use of excessive force in effecting the arrest, and illegal search and seizure. He contends that he is entitled to a new trial because of error in admitting evidence of his refusal to submit to a breathalyzer test. In the alternative, he contends that having admitted evidence of his refusal to submit to the breathalyzer test, the District Court erred in excluding evidence of the dispositions in appellants favor of the state administrative and criminal proceedings which followed his arrest. We find no error in admitting the evidence relating to the offer and refusal of the breathalyzer test and affirm the judgment of the District Court.
